Daughter born in the US, what visa should i apply

Post by olembe » Tue Jul 28, 2015 9:14 pm

Hi,

My daughter was born in the US earlier this year, she was given 6 months visa when she entered the UK. i(the father) have UK ILR and im also in the process of applying for naturalization in the UK. The mum is on a dependant visa (2.5years); please can you advise what visa i will have to apply for my daughter as her 6months visa is about running out

I am shocked that she was allowed in on a visitor visa. She should have applied for entry clearance as a your dependent!

She will need family of a settled person visa... She will not be eligible for immediate naturalisation after you as she was not born in the UK and she was born before you become British.

Is the mother on a PBS dependent visa or did she apply for entry clearance as a spouse of an ILR holder??

I think child may apply for leave to remain, subject to R-LTRC, in-line with mother's leave. Probably on form FLR(O), if applying separately from her mother.

Thanks vinyl,
please i will like to inquire if my daughter cannot apply as a dependant under me rather than as a dependant on her mum as you suggested
