Ofcourse you are exercising a treaty rights here at UK although you are a dual national, it is not a problem.

I strongly recommend you to see a good solicitor who are familiar in EC law. The solicitor may refer a good barrister for you.

As far as I know they are applying the standard immigration rules where the applicant is not resident in another EEA state.

Some EU states (including Ireland) are refusing these applications on principle.
