Is B1 sufficient for FLRM

Post by naija99 » Tue Sep 22, 2015 7:04 am

Morning all
Just wondered if B1 city and guilds from 2013 was ok to submit with FLRM because my friend sent it but his application was granted under 10 years (based on British kids) instead of 5 yearsbased on marriage - they said his B1 wasn't on the approved list - he meets all the other requirements for marriage

Can he take A1 and reapply without paying NHS and home office fee again?

Or can be appeal?

Also, what may be important to note is that his wife was exempt from the financial requirement because she is in receipt of DLA. I don't know if this makes a difference in respect of English Language requirements.

He was told in his letter that you have provided ESOL International city and guilds but this qualification is not from an approved provider.

Can anyone advise on what he should do?

An A1 or B1 test from an approved test provider would be sufficient.

Thank you Vinny
Would he have to pay for another application home office and NHS surcharge fee again? Or could he simply send it to them and ask for his status to be changed to the 5 year route.

There's probably no harm in asking for a reconsideration.

If the acceptable English test predates the previous problematic FLR(M) application, then he shoud ask for a reconsideration. Else, my guess is that they would want another FLR(M) application.

Thanks Vinny
We thought there would be some sort of onus on the HO to at least write and request a document rather than simply granting the incorrect status as all other requirements for FLRM were met.

Unfortunately, the onus of supplying the correct documents appears to be on the applicant. It's not normally the responsibility of the Home Office to request them.
