Visa Application form for elderly Mother & Dependent Sister

Post by perisetty » Sun Sep 27, 2015 10:15 pm

Greetings!

I have ILR and settled in UK. I want to bring/immigrate my elderly mother (60yrs) and dependent sister to UK on a permanent basis
I request your guidance on the
1. Correct Application form for them
2. Documentation required
3. I will get by British passport next year, should I wait or can initiate the process for them straight away.

Thanks and Regards, Raju

Unfortunately not good news. The door to this route for settlement is virtually closed. You would need to show that both your parent and your sister meet the following conditions and have no other family in their home country...
They both need long-term care to do everyday personal and household tasks
The care they need is not available or affordable in the country they live in

The person they will be joining in the UK will be able to support, accommodate and care for them without claiming public funds for at least 5 years
They are 18 or over

The difficulty is, that if you can afford to pay for daily care in the UK, you would be able to afford to pay for it in their home country, unless they are applying from a higher cost country, such as the USA. Also at the age of 60, your mother wouldn't be considered as 'elderly'.
Also bear in mind that if you apply and are refused, future visitor visas are likely to be refused.

Total waste of time and expense. The application alone will cost you £4,000 and will 99.99% be denied.

If it's that important to you best relocate back to your country of origin. Anyway 60's not elderly!!

Thanks for your response. You are right. May I know which is the relevant application form, if I were to take the risk. Regards, Raju

If you risk these applications, which will be an almost certain refusal, you are effectively closing the door on any future visitor visas for your mother and sister as their intention to settled (by way of a refused settlement application) will be known. £4k is a lot to lose for applications that are bound to fail.

As I advised in my previous post, if the application fails no UK visitor visas will be granted for either your mother or your sister in the future. To my knowledge there have been less than 50 successful applications since the tougher rules were introduced in 2012 and the majority of these were following a lengthy and expensive court appeal.

Edit: As usual, 'speedy fingers' CR001 Char has beaten me to it!

Is there an IHS charge in these visas too now? They don't seem to be ILR type visas anymore, despite being 5 years and being lumped in with the spouse-like 'joining a family in UK' section...

Five year visa, two people, that's another £2,000.....

Just a give an actual case that was refused. My friend, over seventy years old, widowed, depressed, not living in her country of birth, no family members in the country, not totally disabled but with some physical challenges, very expensive home care when she needs it, strong ties to UK in the past, was refused the Adult Dependant Visa a few months ago. Fortunately, she still has a visit visa and was allowed into the UK for the five months she requested but the long term prospects are not good. Sorry to be the bearer of bad news!
