Which Application Form?

Post by ILR10Year » Tue Sep 29, 2015 10:33 am

Hi everyone!

I am waiting for my ILR on Long Residence, however, my Husband is on ILR granted on Long Residence basis just an year ago, waiting for outcome of his Naturalisation application.
Our Two UK born Childern has been living with us aged 6 and 8, One child has got Passport (Non British) and Valid Leave to Remain, but other Child hasn't had any Passport, however, both Childern have got Full UK Birth certificates with our (parents) names on it.

My questions are:
1. Are my childern eligible to Register as British Citizen if Father applied?
2. Which Application form for Child Aged 8 with LTR?
3. Which Application form for Child Aged 6 without Passport?
4. Do I have to wait to register Childern until I granted ILR?

Thanks.

As the children's father have ILR and they were born in the UK, they are entitled to register on separate forms MN1 straight away.

A passport is just a travel document. Its absence does not necessarily imply that the child is stateless. S3 may require additional proof that the child was also stateless (e.g. confirmation from your embassy), which is probably irrelevant for MN1 under Section 1(3).

*******************UPDATE WITH QUESTION*****************
Good news:
Just to update that my Child aged 8 has got Naturalisation Certificate. Will apply for BP this week.
Bad News:
My ILR was refused just because SoS believes that proxy was used during my Spoken English test. Waiting for in-country hearing now.

Scenario: I'd like to apply for Naturalisation of my Child aged 6, who's born in UK & has got UK Birth certificate and goes to local school regularly, this Child wasn't mentioned as Dependant ever in previous two LTR applications, as we're not intended to go outside UK so this child had no passport ever for last 6 years, however, both Childern were mentioned at the time of Appeal. Now, ...

Q1. Can Father with ILR- (No benefits applied even Child Benefit for both Childern yet) may apply for Naturalisation for this child? or better WAIT until either Father's Naturalisation application is decided / or my appeal is deciced/ or Child becomes 10 years old?

Q2. Is there any legal obligation that an Int'l Student-Mother to inform Home Office once Child born in the UK?

Many thanks

No, not required for a UK born child as they are entitled to register as British once a parent has ILR.
