is the SS Route sucessful with or without full 5yr GNIB Card

My wife failed to get her full 5 year GINB card as we left a month early but in ireland over 6 months and applying for the residence card in the uk, will not having full 5yr card from ireland weaken her case or the temp card ok? rest of documentation we have

we are in uk with the family permit

You have a family permit so i doubt it will make a difference.

You dont have to apply for eea2 since you are legal even when eea fp expires.

what do u mean legal even when the fp expires? i thought u had to apply for eea2 uk residence card?? also i read about extending the family permit if my wife gives birth in the uk??

Even if he eea fp expires your wife is still legal.

Eea2 is optional.

You have already activated eu law since eea fp has been given.

Only reason you need eea2 is if wife is gonna work or travel out of country.

Its recommended but not mandatory.

we are applying for it as it gives her the 5yr residencey in the uk , is it pretty straight forward to get it granted??? also can she work with eu family permit? seems a bit odd she could over stay once the family permit expired thou

With the unlawful centre of life. I don't think UK will see it that way.

How long do you suggest staying in ireland?

Ive been here for over 6 months looking to stay another 6 months.

You reckon that should be enough?

If the eea2 card is optional then why bother?

Wouldnt it be best just to wait till centre of life is struck down then apply?

When do surinder singhers need to apply for eea2 once they return?

Can it be anytime once you return?

1 year later or even 2 years.

susposed to apply for it before family permit expires otherwise my wife would be illgally in the uk then get banned for 10yrs, end of the day if we fail COL test we take it to court that fails we prob just have to move back to ireland or might even go get jobs in malta exercise my treaty rights there , uk needs to make life more reasonable for spouses, my wife be with a 2 month year old child then if they kick her out the uk it would have to be taken to court it be un reasonable for immigration to expect my wife to travel home leave her child here in the uk who would be a british baby as it will be born here

I believe your wife will not be removed.

Once the baby is born there will be a strong prospect of success under the rules for success.

Even the centre of life test , there is a good prospect of success in challenging it at the Tribunal , as it is not wholly consistent with EU law.
