EEA(FM) Perminant Residence Section4 Category Question

Hello,

I am applying for the EEA (FM) Permanent Residence card to live and work in the UK with my French wife.
Completing the application form we are stuck on Section 4 "Category of Application" question 4.2 and don't know if we should tick "EEA national who has permanent right of residence in the UK" or "EEA national is a qualified person (work,self-employed...)"

She never applied for a permanent residence card with the UK government as she is a French citizen and therefore has the right to live and work in the UK permanently as part of the EU. Would her passport qualify as "document certifying permanent residence"?

Anyone who could help us shed some light on with section we should tick would be greatly appreciated

Your wife will have acquired Permanent Residence if she live and exercise treaty right(work self employed- selfsufficient with CSI or student with CSI) for 5 continuous years in the uk! Do you curently hold a 5 years resident card?

No, a passport does not serve the purpose of a "document certifying permanent residence";
(a passport is just a travel document & proof of ID).

Your dates, timelines and sponsor's (ie spouse's) economic activities in UK over the past 'x' years will help you answer your question.
(As well as details of any FP & RC as asked by previous poster).
Can you share?

Thank you both for getting back to me.
She is a French citizen and therefore does not require any specific papers or permissions in order to live and work in the UK.

She have lived and worked continuously in London for now a little over a year so even if she wanted to apply for a permanent residence card she does want to apply as it says a minimum of 5years.

So in that case does she qualify for the "qualified wormer (employed)"?

I am slightly confuse! Who is the residence for? You or your french partner? It is indeed correct that your french partner does not need permussion to work and live in the uk but if she want to acquire Permanent Resisence she will need to have exercise treaty rught for 5 continuous years as explained before.
