Tier1 Entrp switch to Dependant

Hi All,

My situation at the moment. I am on a Tier1 Ent visa and will be completing 3years in 2016. I am here with my Spouse who is on a dependant visa. My wife now has a full time job and the company she is working for has agreed to sponsor her visa as a permanent employee. So I was wondering if I could now switch visas and become her dependant how would it affect my ILR options after 5 years. Would I be then eligible to to apply for ILR after completion of 5 years of stay. 3years Entre + 2 years Dependant ? Or will I be eligible after continuous 5 years as a dependant. I am in a confused thought process at the moment. If someone could help me out that would be really helpfull.. I hope i have not confused you .. .. Thanks ! This forum has been great !

If you switch to dependent visa, you will have to wait 5 years on dependent visa before qualifying for ILR. You cannot combine the time you have spent on Tier 1 Ent towards the 5 years.

Also, I will be completing 10 years by 2019. This includes 2years study + 2 years PSW + 3 years of Tier1 Entre + 3 years as a dependant. So do think i can then qualify for a 10 year long residency in that case ? Let me know. Your feedback is helpfull..

Any legal visa status in the UK counts towards ILR based on 10 years long residency.

I provided my original answer based on the limited information you provided, i.e. 5 years residence.

First of all Iam on Tier1 Entrepreneur visa(main applicant).
Hi prajwal, you said that your wife has a job and her company is happy to sponser her , but I think dependants are not allowed to switch the visa from Tier1 entrepreneur to Tier 2 IN THE COUNTRY(UK). The application has to be made OUT OF THE COUNTRY ONLY.
-- So my question is does the company allows your wife to go back to your country and apply Tier2 from there ?
-- and are you (as a Tier1 entrepreneur Migrant) allowed to switch as dependent of Tier 2 in the country(UK) ?

@ CR002 - Correct me if iam wrong and also please kindly reply the answers for the above question and let me know the following too please,
- can tier 1 entrepreneur switch to tier 2 migrant (main applicant) in country ? (same above question)
- If my wife(my dependent) go back to our country and get tier2(main applicant) visa and come back again, can I (as a tier 1 entrepreneur )switch as dependent of tier2 IN COUNTRY?
-- Can my wife(my dependent) go back to our country and get tier4(student main applicant) visa and come back again, and after that can I (as a tier 1 entrepreneur )switch as dependent of tier4(student visa) IN COUNTRY ?
