SET(M) application further investigation

Post by dev_vinay » Tue Oct 20, 2015 1:08 pm

I came here in 2008 as Tier 1 and I got my ILR in 2014 December. We have a kid born in September 2014 in India as we did the delivery in India.

We went to Croydon Home office on same day service application as SET(M) and after 6 hours of processing they said our application needs further investigation and they will get back once it is done. They have not mentioned any topic which needs investigation.

We were living together from January 2011, but my wife had an absence from UK from June 2014 to Feb 2015 when she went to India for Delivery.

We have submitted the NARIC certificate as English language proof. Rest of the documents are same as when I did submit my application.

Could any body abel to help me on what topic they are going to investigate further?

What visa did your wife/child have?

If PBS Dependent, then Set(M) is the wrong form.

Or if she qualified for ILR, then it is form SET(O)

If its wrong form what is going to happen? Are they going to refuse it or change the category?
I paid £3800 for same day service.

Possible that they will give her a 2.5 year spouse visa (FLR)M), if not refused, which will then mean another 5 years before ILR, or if she meets 10 years long residence before that.

Who advised you to apply using Set(M)?

2 X Set(M) - wife and child @ £1,900 per applicant.

Sorry, I got one more question.

In the letter I got they said "Your application is Valid" . So even if I have used the wrong form Why did they say that it is "valid" ?

Thanks

Using a wrong form does not normally make an application invalid. If they haven't decided, then vary her application to SET(O) or FLR(M), whichever one is appropriate for her.
