court order to vocate the property

Hi All,

I am new on this forum. I want to apply for British citizenship in coming month. But recently I got court order to vocate the property I was living and also order to pay court fee to your landlord.

I was looking for properties and the last date has been passed and my landlord apply for baliff. I hand over the keys to bailiff and moved to a friend house in emergency. One more thing landlord never ask me for any money even I asked if about the court fee. He said I paid it and you don't need to pay me.

Now my question is after all this happened am I eligible to apply for citizenship?

It is a civil matter not a criminal one. It will not affect your citizenship. People get evicted all the time. However, if you don't pay the court fee, your landlord can apply for a CCJ against you.

If the court has ordered you to pay the court fee, I would strongly suggest you pay by bank transfer to your landlord to cover yourself. What the landlord is saying is not relevant as the decision on court fee has been issued with a court order by the county court judge/court. Your landlord would have completed the possession paperwork asking for court costs to be paid by you.

If you don't pay and you just take what the landlord is saying at face value, he can applied for a CCJ if you do not pay it.

The court order says that I don't need to pay the court fee to court directly as the landlord already paid the court fee. When I phoned my landlord about court fee he said no I don't want the court fee and said I paid it from my side.

I spent 40 months with that landlord and paid my rent on time.shell I take a letter from my landlord that I have fulfilled all the liabilities?

You don't pay the court fee to the court. If you read the possession order carefully, bottom right somewhere, it will say you have to arrange/pay landlord directly.

The landlord paid the court fee when he submitted the request for possession order paperwork to the court. If you were evicted by Section 21 notice, your landlord DOES NOT need any reason to evict you. Was your deposit protected and prescribed information etc provided for each tenancy agreement? You can PM if you wish.

This not relevant to immigration though, but I would pay the court fee to your LANDLORD, as the court instruction,if you have not applied (or he has) to vary the court order regarding costs.

Still no effect on naturalisation application though.

CR001 If the landlord apply to court for the recovery of court fee from me. Will the court send me any letter to pay the amount to the landlord, I mean, will there be any prior warning from the court or from the landlord? Or court straight away Issue CCJ?. Landlord has got my new address and I also have permission from my landlord for letters collection from my previous address.

Not sure but try and avoid that if possible. The court fee is only £300 odd, pay it if you can as directed by court to avoid any nasty surprises later. There is a landlordzone forum where you could register and ask for clarity if you wish.

No, it is not a criminal case or anything. You were evicted, it is a civil matter and not a record against your name.
