Refused British Passport for Doughter

Hi. Me and my partner(polish) are both in UK since 2008 failed to register with WRS.On 28th May 15 our little girl Was born. Applied for british passport and refused it becouse we didnt register with HO. I dont really know what to do now to get her a passport what are my options. Can anyone help please?

Did you apply for your child Naturalization, using MN Form? or one of the adults using AN form first?

No we didn't apply for anything else.
So is my thinking Wright to apply for PR after May 16 and when both of us got it than apply for a passport for LO?

Once you have attained/acquired PR, you will need to register your daughter on form MN1 as a British Citizen under section 1(3) of the nationality act (an entitlement to register) before applying for her passport. The current cost of MN1 applications is £749 and fees go up every year in April.

As of now, your only option is to apply for MN1 in April 2016.

If the judgement that vinny cited , is upheld, then you can seek compensation from the UKVI, as it will mean your child was a citizen at birth, and it was unlawfull for her to be registered. The registration is there ultra vires as he did not fall into 1 (3), but 1 (1) on the date of his/her birth, and therefore your fee should be refunded.

Just spoken to Citizenship & Nationality Enquries and they said that we need to apply for PR in 2016 and than phone to find out what we can do to get a passport for doughter. It looks like a lot to do to get it. I cant apply now for MN1?

Once they say that after 5 years in uk there is no need to apply for PR as it is automaticly given. So confused now.

You can apply for yourself using AN form, but you need provide B1 English test plus Life in the UK test results, as if you have been here for a number of years
