UK Citizenship for EEA children - right to register

Post by Lcasm » Mon Nov 09, 2015 10:20 pm

Hello, I'll appreciate your advice.

My husband (an EEA citizen) and I (Non EEA) arrived to UK in 2006, I had a family permit and registered for a Residence Card, etc.

We both worked until 2012 when we moved to another non European country.

During our time in UK I gave birth to my sons in 2008 and 2009. Both my husband and I worked during our time in the UK.

We never registered as PR and therefore my children don't hold UK Citizenship.

My question is, would we be able to register them as UK Citizens even after leaving 3 years ago? Did we miss it by not registering for PR and applying while we were still in the UK?

Any advice will be appreciated.

No as you have likely lost the right to apply for PR due to the 3 year absence. PR is lost after 2 years absence from the UK. Are you in the UK now?
Did we miss it by not registering for PR and applying while we were still in the UK?
Yes, you would have to start the years exercising treaty rights again in the UK to qualify for PR.

Thanks!
No we are not in the UK or Europe. My children hold a EEA Citizenship but since they were born in the UK I just thought I'll ask.
We have no plans to return to Europe for the time being.

Thanks
