Do you mean your wife is currently here on visitor visa? If so, she can't be seen to be spending more time in the UK than she is in her home country. The general guidance is no more than 6 months within a rolling 12 month period. If she submits another visitor visa immediately after the expiry of the current one, the application is likely to be refused as the ECO will consider that she is using visitor visas to reside in the UK, not to visit.mtebbit wrote:Is there somewhere to find out about visitor visas on the forums? My wife's visa will expire at the end of Nov, what's the earliest she can come back to the UK on a visitor visa? The government website isn't 100% clear.
Err, no. It is not discretionary. Each case would be based on the Rules.mtebbit wrote:I know each case is taken on a discretionary basis...
One of the rules explicitly states that the person should not appear to be residing in the UK in the guise of visit visas. Your wife was very lucky to get a visit visa in spite of having a UK resident spouse.Casa wrote:Even more so as you are resident in the UK and your wife may now be considered to have stronger ties to the UK than she has in her home country.
