refused EEA4 application

Post by natejenny77 » Mon Nov 16, 2015 1:54 am

Hello, need advice on what to do.
I am a non eea family member(husband) and my wife and i applied for PR which was refused due to lack of medical insurance when she was self sufficient for 2 years due to us having a baby. Now she's self employed and my employers are saying that i don't have the right to work in the UK. Is this case? Please advice
Thanks

A qualified person may also be self-employed. Therefore, you should also have the right to work in the UK.

Apply for another residence card.

What was she doing before the birth of the baby?

She was working as an estate agent. Her application was refused because she couldn't provide medical insurance for the 2 years that she was self sufficient

But if she left work to look after your child then she was clearly a worker. Provided of course she returned within a reasonable period.

There was no need to bring in self sufficiency .

Hi Obei,
Please I just want to know the reasonable amount of time you refer to e.g a year after given birth or a year and half.

Thanks for your professional input.

She didn't return to work. She became self employed in 2014.

Like Obei said if it is just for a year of maternity of looking after the baby or there was a strong medical reasons for an extra one year to make it two years as you mentioned, then you argue with HO.

I think you can try through appeal or just admit the mistake and apply for new RC before thong change.

Good luck
