UKWORKPERMIT OVERSTAYED - HSMP APPLICAITON

Post by wanker » Thu Nov 22, 2007 5:38 am

I am an indian national, came to UK on a IT WorkPermit in the month of dec 2001 with visa validy till Feb2005, i had overstayed from feb 2005 till sep 2005(7 months). When i decided to come back to india as i am unable to get my extension,so while coming back to india, before boarding the flight, the immigration officials at heathrow airport in london have checked my passport and asked me the reason for overstaying in london for 7 months, i could not give any genuine reason so they have taken me into a room and took my passport and came back to me after some time to tell me that i have breached the immigration rules by overstaying for 7 months and can never come back to UK and had written as "LHR TN3 EMBARKS ON dd/mm/yyyy.
> when i came back to india, Since 2 years from now i am working for a IT company, as i felt that i am lacking of management skills i have decided to pursue my MBA.
>
> now my questions are:
>
1) I am 36 years old , i am married and i have a kid ,If i apply for Student Visa, will i get an entry clearance i have already breached the rules of immigration in UK by overstaying for 7 months.
2) My intention is only to study MBA , not to settle down in UK.
3)However i qualify for HSMP as i have a bachelor's degree which would fetch me 30 points and my income is 8.00 lackhs/annum which would fetch me 45 points.

WILL I GET AN APPROVAL FROM HOMEOFFICE AS I HAVE BREACHED THE RULES OF IMMIGRATION 2 YEARS AGO.

EVEN I GET AN APPROVAL , WILL I GET AN ENTRY CLEARANCE.WILL THE HOME OFFICE SHARE THE INFORMATION WITH THE CHENNAI CONSULATE
