French national

Post by Sihe1408 » Tue Dec 08, 2015 8:04 pm

Hello, I'm thinking od requesting British citizenship and have been researching a lor but I'm still very confused as I keep reading contradictory info. Appreciate this might have been posted before but i did search first and could not find anything like my case. I am a french national ( born and raised in France) married to a French national. We have been living & working in the UK since 2007 and our two kids were born here in 2012 and 2015 ( they hold a french passeport).
My questions are do i need to request permanent residency to apply for british citizenship? Will I then need to wait 12 months before applying for citizenship? Also i was recently told that my children could get a british passeport even f i don't since they were born in the Uk is this correct?

Finally my father was tunisian so when I was born i automatically got the tunisian nationality from him but I do not hold neither passeport or ID card from Tunisia. When i apply for british citizenship will i still need to declare both french and tunisian citizenship although i have no tunisian papers to prove it? Thanks in advance

You now need a document certifying PR when applying for citizenship; this change came into force on 12/11/15.

It is quite unclear as to whether one needs to hold the document for one year or whether it is sufficient to have a document which was issued less than one year ago as long as one has held PR for a year from the date it was actually acquired.
However, given the costs involved in an application for naturalisation paired with the fact that there is no right of appeal if rejected, I'd strongly advise you to only apply once you have held the document for one year.

If your children were born after you had exercised treaty rights for 5 continuous years (i.e. acquired 'settled status/PR'), they are automatically British by birth and you can apply directly for a passport for them. If they (mainly thinking of the one born in 2012) were born before this, you first need to register them as a British Citizen (use from MN1) before you can apply for a passport.

You should list all your nationalities in the application, even if you do not hold travel documents/papers issued from your country of nationality.
All information given is just my opinion as a member of this forum and does not constitute immigration advice.
