Can an EU spouse enter UK without a Visa?

My friend is has got a 10yr resident permit in France. She has just married to a German citizen. Her son from a previous relationship is a french citizen. She would like to visit UK for holiday with her son. Did she need a UK visa? Thanks

It is a residence card, issued to you as the family member of an EEA national who is exercising free movement rights in another EEA State (i.e. not your EEA relative’s Member State of nationality) under Article 10 of Directive 2004/38/EC.

Article 10 Residence Cards are valid for only five years. So the fact that she has got a 10 year RC suggests that it was issued under domestic law, not EU law (Article 10). So, it would not be valid for travel to the UK.

But your friend would have the right to a free and expedited UK visa on the basis that she is the mother and wife of EEA citizens. In theory, if she were to travel to the UK with them, she would not need a visa, but she could face delays of hours at the immigration desk when entering the UK and it would be much better for her to have the free visa in advance.

If it is an Article 16 Residence Card, the person is allowed to Enter UK.
