british citizenship for children

Post by Lawode » Thu Dec 17, 2015 6:59 am

Please want to find out wether I could put MN(1) for my children born before I became a Naturalised British citizen, the kids are less than 18 years and they are not in UK

Can I apply for MN1 certificate here in UK without them in the UK or are they automatic British citizen?

Where were these children born?
What is age & immigration status of each child?
How much time have they spent in UK (if any)?
What is nationality/immigration status of partner/spouse?

The first child is 15, second child11 and third child 2 years old

The children are currently in Africa Nigeria with mother but Father got his Bristish citizenship this December 2015

The children have never travelled to UK before. Can I register them as Minor Naturalised Citizens

No, you cannot. They don't qualify to apply for citizenship if they have never lived or been in the UK.

In line with what CR001 has mentioned:

None of your children qualify to be registered as British Citizens under any section of the British Nationality Act.
Because they are not eligible, there is no application that you can file.
Life isn't fair, but you can be!

The status of children born outside the UK is in line with that of the less-privileged parent.

So, the children will have the immigration status of the mother, in this case.

If you wish to register the second and third child as British citizens, their mother must move to the UK with them. When she gets citizenship in five years time, the children can be registered as British citizens.

Your eldest child likely can not be registered as British because he will be an adult by the time your wife gets citizenship. He will need to do the immigration journey on his own.

Alternatively, you could look at using the Surinder Singh route to get him and the rest of your family to the UK. Your eldest son will get PR status in the UK under that route and will need to qualify for citizenship independently of you.
