hi ,
I am a new member of this forum.
I have T2 ICT long term leave to remain with a sponsor .Let me know I can apply ILR? if yes do I have to pass life in the UK exams and Esol level 1 language exam ?
my visas up to now :
2012-2015 T2 ICT long term leave to remain
2010-2011 T2 (Intra company transfer: established staff)
2009-2010 T2 (Intra company transfer)
2008-2009 leave to remain as work permit
2007-2008 leave to remain as work permit
2006-2007 leave to remain as work permit
2005-2006 leave to remain as work permit

You can apply for ILR.
You need to pass the Life test. I believe if you have a Bachelors degree and it was taught in English you no need to do a language test.

you are eligible to apply but must meet all the requirements

Hello Manci,
The following is my UK Visa history
1. C – Visit – Business: 13/10/2008 – 13/04/2009. Did not travel
2. Tier 2 (Intra Company Transfer) Migrant: 01/06/2009 – 14/01/2010. Did not travel
3. Tier 2 (Intra Company Transfer) Established Staff: 11/08/2010 – 21/08/2011. Travelled on 30/08/2010
4. Extended twice now in UK.
5. Current Visa: T2 ICT Long Term: Valid till 21/08/2015. Up for extension
Based on the above my questions are:
1. Is there any chance of me being eligible for ILR this August (2015) based on me having an ICT before April 2010?
2. If not, can I extend my visa for 5 years under a single extension and then apply for ILR?
3. Is there any chance to changing to Tier 2 General without the cooling off period?

unfortunately not, see immigration rule 245GF (c) and (d)

yes, with a corresponding CoS, provided the extended leave is at least to the end of the 5 year qualifying period

yes, you can switch in-country but only if you change sponsor

I came to UK in Dec 2009 on Tier 2 ICT visa. On 06 Jun 2011 have returned to India (visa expired), but got a new Tier 2 ICT LT visa from same employer within 25 days of previous visa expiry on 28/06/2011 (Under new rules in place then) and returned to UK on new visa and extended once since then. I've completed 5 years in UK, Would I be eligible for ILR? All other rules are satisfied like minimum payment and continuous period etc...

Thanks Manci. based on the details on P29, I seem to be eligible as I was back in UK with 28 days... will apply for ILR and update here on what happens.

Have applied for ILR last week and was approved... The case worker just discussed the details of my visa extensions for clarification nothing more... everything completed within 2 hours...
Here are the details of my Visa extensions ...
I’ve first got my Tier 2 ICT Visa on 14 Dec 2009 (Valid until 06 Jun 2011) and arrived in UK on 03 May 2010. The visa was not renewed on time and this was spotted on 09 Jun 2011 (late in the evening). A decision was made that I (along with my family) travel back to home country and get a new Tier 2 Visa. We’ve returned to India on 11 Jun 2011. Once reached India, we’ve applied for a fresh Tier 2 Visa and got the Visa approved on 28 Jun 2011 (valid till 02 Aug 2014). (In the Visa application we’ve mentioned that we’ve overstayed by 5 days and the reason for the same also.).
My wife had to undergo a surgery on Sunday 26 Jun 2011 (Medical Certificate attached). Even though stamped passport has arrived on 01 Jul 2011, she was not allowed to travel for about 2-3 weeks. Once we got a go ahead from the doctor, we’ve booked flight tickets for 16 Jul 2011. The flight was cancelled in the last minute due to technical fault and we were rebooked for 19 Jul 2011 (an email from BA and immigration cancellation stamp on my passport). Started to work from London office again from 20 Jul 2011.
During the period between 11 Jun 2011 and 19 Jul 2011 I’ve worked from office in India.
In July 2014 I’ve applied for visa extension through postal application along with my family. But on 16 Aug 2014 my Father-in-Law has died in a road accident in India (Death Certificate copy attached). I had to withdraw the application as my wife had to go back home immediately. After I received my passport, I’ve applied for visa extension in-person (using premium service @ Solihull) on 26 Aug 2014 and visa was approved on the same day and is granted until 29 Jul 2016.

Hi Guys,
I am currently in UK on Tier-2 ICT Long Tem Dependant visa applied in July 2013. I cam e to Uk in May 2014.
Q1) Can I switch to Tier -2 General visa if I find a sponsor in UK?
Q2) Do I need to serve cooling period of 1 year same as main applicant for applying Tier 2 General visa?

I have recently heard from my fried that under some rule (i guess 546), if your are established staff category on Tier2 (ICT) before switching to Tier2 General, your stay on ICT will be counted while applying for ILR (if an only if it is before Apr-2011)
Please let me know if that is true
