Application for EEA PR card

Hi everybody

I’m new here and thanks everybody in advance for any valuable contribution.

I am a Turkish citizen who is married to a French citizen and my 5 year EEA family permit will expire in August 2016. When I first came to UK, they issued me with a 6 months EEA family permit and after that I’ve received my 5 years EEA family permit. I am in the midst of gathering my documents for EEA Permanent Residency (PR) card.

My questions are:
*As my EEA family permit expires in August, can I apply now for the PR card?
*Would my first 6 months EEA family permit be counting towards my 5 years exercising the treaty rights? Or do I need to wait for my 5 years EEA family permit to expire?
*How long the process appx takes?

Your application for confirmation of PR depends on your spouse's activities as a qualified person in UK (not yours).

The EEA national (sponsor) is the one who has to have been exercising treaty rights in UK continuously for 5 years.
For example as a worker, student or self-employed qualified person.

If you have both been married (to each other) for at least 5 years and you have been in UK for 5 years whilst your spouse has been exercising treaty rights here for 5 years then you should have automatically acquired PR.
You can then apply for the 'confirmation of PR' card.

So the earliest you can apply depends on when you and your spouse arrived in UK
and
how long you have been married.
and what your spouse's ctivities have been in UK.

Note any absences from UK (by you &/or spouse) must have been within the prescribed limits in order to maintain your continuity of residence in UK.
