Changing Tier 2 ICT visa to a dependent of british citizen

Post by polyukba » Tue Dec 22, 2015 2:32 pm

Hi,

First of all, thanks for your time for looking into this post. Your guidance is much appreciated.

I got my british citizenship by Feb 2015, through Tier 1 (general) followed by ILR. I got married earlier this month in India. My wife is already in UK from July 2015 on Tier-2 ICT (Short term), so her visa is getting expired by June 2016.

1. I want to apply to change her visa type from ICT to a dependent category. Initially I was confused to choose between PBS dependent or FLRM, but after going through multiple posts here, I understand FLRM is the right one to choose (Please let me know if this is right).

2. She moved in with me only from Dec 2015, until then she was living separately, On page 62 of the form under Relationship - It says "Six items of correspondence addressed to you and your partner at the same address as evidence that you have been living together since your last grant of leave in this category". But because she moved in recently, we do not have many correspondence on her name. Since I'm applying for the first time under this dependent category for her, I'm assuming that this will not be applicable in her application. But wanted to double check before proceeding with the application.

Please let me know your views.

Thanks.

1. Yes, FLR(M) is the only option she has if she has not been in a dependent of you category previously.

2. Not required for newly married to submit 2 years cohabitation documents. FLR(M) is used for various stages including extensions etc. so the form is badly worded and confusing.

She needs to meet the English language requirement for FLR(M), so don't forget.

She has her Original engineering degree certificate from India (which she had used for her ICT visa as well to prove her English knowledge for PBS), Will this be sufficient?

Should be fine if she has PBS calculator points and/or NARIC English assessment. See this thread (click)
