LOTR holder can switch in country for 5 years route?

I am asking if any body granted LOTR leave to remain outside the rules which is in bases of 10 years can apply in country for 5 year spouse visa if he is qualified to every requirement. most of the lowers says you cant apply to any route within the country you need to move outside and apply which is not making sense and I didn't find rule that you can't apply to 5 year rule if you are in UK with LOTR Leave to Remain Outside The Rules. and the other question is If some one Apply from inside uk for 5 year route and refused are that's will jeopardise his existent LOTR visa Or reset his period to start again from the beginning?
