Dependent of ILR long residency

Hi Guys,

I am eligible to apply for the ILR Long Residency as I entered the UK in January 2005.
My wife joined me as a Student dependent in May 2007.
My Tier 1 visa expires in August 2016.
We both are full time employed and have not been out of the UK for more than 30 days ever.

What I want to know is the following:

1) Can my wife apply along with my application?
2) If yes, which application form should I use?
3) If no, when can my wife apply? which form should I use for her application?
4) What are the documents that I need for my application and for my wife's application
5) Do I have to pay for the Immigration Health Surcharge for my wife?

Can you please guide me to the best way of getting the ILR done?

1) Can my wife apply along with my application? Apply for what? There is no option for dependents to apply with you if you apply for ILR based on 10 years long residence.
2) If yes, which application form should I use? She will need to switch to FLR(M), there is no other option available to her if you apply for ILR based on long residency.

4) What are the documents that I need for my application and for my wife's application Please do read the Set(LR) form and guidance and the FLR(M) form and guidance and then ask if you have further questions.
5) Do I have to pay for the Immigration Health Surcharge for my wife? Yes, it will be £500 on top of the visa fee.

Would my wife have to pay £500 for the surcharge even if she has been in the UK for over 8 years? She has paid all NI since she was here !

I have been on tier 1 for 4 years now.
So what should I do now? Please advise.

Yes, you wife will have to pay the surcharge, she is not exempt from it.

It would be easier and quicker for both of you to apply for ILR at the same time based on your Tier 1 + dep visa. When do you meet the 5 year residence requirement?

Agree with CR001. It may be better if you can wait and apply for SET(O) under Tier 1 (General). Then you may also include your wife.

Hi,

I need some advice please.

I got my ILR (10 Year Route) in August 2015.
My wife:
- Entered in UK in May 2007 as Student Dependent
- Became Tier 1 [PBS] Dependent in August 2011 [2 + 3]
- Her visa expires in August 2016

I want her to get the ILR as well as we want to apply for a mortgage. How should I go about it? She will be completing 10 years in May 2017.
What form should I use? What are the required documents?

Any advice would be really really appreciated.

She will have no other option than to apply to switch to FLR(M) and meet all the requirements (English and Financial) and pay the immigration health surcharge of £500.

When she reaches 10 years long residence, she can apply on Set(LR).
