Hello everybody.

First of all, I hope you all had a fantastic Christmas and I hope you'll have a New Year filled with everything you are wishing for!

Just found out that I need to have the Permanent Residence in order to apply for the citizenship.

As expected the EEA(PR) form is not straight forward, and I would appreciate any help I can get with it!

I am an EEA citizen, moved in the UK in 2007 and I am in a Civil Partnership with a UK citizen since 2011, I received my UK Residence Documentation (Blue card) in Jan 2013.

From what I've seen on the application, as the Civil Partner of a UK citizen I understand that I must fill in the Sections 1, 2, 3.2 and 11, but I could be mistaken.

My questions are:

1. I know that the PR requires to be a resident for 5 years, since we are in a Civil Partnership since 2011 does that cover it?
2. Section 3 of the application, do I fill in 3.1 or 3.2 or both?
3. If anyone was in the same situation, what were the sections filled in the application?

what application category are you filling, so that it is easy to look at the section :)

Thank you for your replay.

I am Romanian citizen.
As for category, I don't know which one to apply for, as I asked "2. Section 3 of the application, do I fill in 3.1 or 3.2 or both? "
I applied for the Registration Certificate as the civil partner of a UK citizen, do I do the same now as in skip 3.1 and go straight to 3.2 1st option and fill in only Section 11?

i still did not get you because you said you dont know which category you have to apply, but you are saying about filling about some sections ( where did you see this sections)? Can you tell me what application are you looking at?

Hi Sandy

The application is in the Subject of the post, EEA(PR), the sections are part of the EEA(PR) form. Section 3 of the form says which categories you can apply under, there are many, and not all of them are relevant to my situation which I already explained.

Hi mate
now i understand. because you are EEA national you do not have to fill the bio metric section as well as the sponsor details. this only applicable to Non EEA national who is applying for PR card.

you have to choose
I’ve lived in the UK for a continuous period of five years as an EEA national qualified person,
the family member or extended family member of a qualified person, or a combination of
these (on section 3.1)

As you are an EEA national you do not need Sponsor to stay in the UK under the EU regulation so that you just have to establish the 5 yrs treaty rights

But there is the catch...
Can I also choose 3.2? ... "3.2 If you are (or anyone applying with you is) applying on the basis that you/they are (or have been) a family member or extended family member during the qualifying period, tick the relevant box(es) below and complete the relevant section(s) as directed. - I am or have been the spouse, civil partner, or unmarried or same-sex partner of the sponsor. Complete section 11."

When I applied for the Registration card (Blue card), I applied as the Civil Partner of a British Citizen, Can I now apply for it the same way and tick 3.2 instead of 3.1?

yes you may

but Its more necessary for non EEA national. But again worth give a call Home office EEA application prior to apply.

have you worked in the UK before the blue has been issued? what were you doing ?

I was self-employed, but I want to keep the consistency and go on the Civil Partnership line.

You should only fill in the sections tht apply to you as you are applying for PR in your own right, not through a sponsor. As far as I am aware, your partner's details are irrelevant for the PR application.

You need to tick: " I have lived in the UK for a continuous period of five years as an EEA national qualified person, the family member or extended family member of a qualified person, or a combination of these." and then only complete sections 5,9 and 16-19.

Yes your parter shouldn't matter, I think you should have acquired PR in your own right providing you have been self employed for a continuous 5 year period (exercising treaty rights).

As the post above says, you need to do sections 5, 9, 16, 17, 18 and 19. Completely ignore the biometric information section as it is for non-EEA only. The form advises only printing pages which you have completed and the cover page (I ended up printing about 25 pages out of the 85).

Make sure you show sufficient evidence of your self employment for a continuous 5 year period ending at least 12 months before the date you apply (if you don't want any delays before you can apply for naturalisation).
