FLR(M) application time confusion

FLR(M) application time confusion

hello everyone,

My spouse visa is due to expire on 12/06/2016, my concern is that the entry stamp on the visa was on 10/12/2013. however I had entered the UK for a week on 03/11/2013 (with the same spouse visa) but the officer back then did not stamp the visa but the back of the page.

I was thinking of applying for FLR on 15th May 2016. But since the stamp on the visa indicates the entry was on 10/12/2013 there will be a shortfall of at least 25 days to complete 30 months.

Should I refer to my entry on November or the one that was stamped on the visa?

and in my case when is the best time to apply?

Not quite sure about that... if you entered using that visa the first time they should have stamped it on that date regardless of how long you would actually be in the country for given that it's for 2.5 years.

I would say to apply by post a couple of days before the visa expires.

Does that mean that entry stamp in November is meaningless and does not count? And I should count from 10th December

Would using premium service help?

You can use premium service for an on the day decision. I would suggest apply at the end of May.

Would it be good to use premium service on June 8th? If so, would it be a problem if there is a small shortfall to complete the 30 months mandatory period?

You should be fine on the 8th June.

Remember that when you get to ILR, you can apply up to 28 days before hitting the 5 year residence mark.

Also, a point to note, if you have your airtickets, boarding passes etc of arriving in the UK, they will also work as proof of when you arrived initially.

looked for the tickets but could not find them. anyway I will try to apply on the 8th June via Premium service. hope this would be fine.
