Help required to get documents back

Post by iffikhan » Sat Jan 02, 2016 4:04 am

Hi All.
I am married to a French national in March 2013.
i applied for spouse visa in October 2013 and received a refusal letter at the end of March 2014.
i appealed in April 2014 and my court hearing date was in November 2014 which was adjourned as the judge was on holidays.
i received another date in April 2015 and my appeal was allowed on 24 April 2015.
HO told me wait for 90 days to ask for documents after 90 days they asked me to wait for 90 days more.
after 6 months i called them again and they told me that i will get my documents on 11 Nov 2015 but they send me a letter stating to submit my passport. i replied in letter that i already have submitted my passport along with my application on 03 October 2013 but no reply from them.
i filled online form on 14 Nov " Return my Documents" and no reply from them on 8 December i filled another form online " Progress Report Form for Return My Documents" but no reply from them.
Please help me as my Passport is expiring on 23 April 2016 and my company already informed me to submit my visa and new Passport or otherwise they will terminate my employment.
I called HO again on 22 December and they told me that they will do something. i dont know why they are not returning my documents.

I need your help please i live in Ilford, East London.

You need to make a compliant and send a Pre-Action protocol.

Inform them that you will seek damages for any breach of your EU law rights if the breach result in you loosing earning .

Give them 10 days to respond, and commence legal action.
