British Citizen dependent

Post by haseebkhan79 » Wed Jan 06, 2016 4:44 pm

Dear friends

I am currently on my first 2 and half year spouse visa and when I got this visa my wife was on ILR and now she has completed her one year period and applying for naturalization. So my queries are as follows:

1. After my wife naturalization, do I need to reapply for visa as a spouse of British person or my existing visa will be continue.

2. If I have to apply for new visa then is my time clock for 5 years starts again.

Looking forward for the reply

Haseeb

1. Existing visa will continue. Spouse of ILR or Spouse of British Citizen is exactly the same visa.

Dear Moderator CROO1
Thanks for the reply , one of my friend ( not a solicitor ) told me that in this case you may need to change the BRP otherwise this may be a conflict when you are a spouse of British national whereas in your BRP it is mention spouse of a indefinite leave to remain when I will apply for an extension. what you think.

With regards

It is the same visa. It does not make a difference and the BRP card DOES NOT have to be changed or visa changed. Goodness, I think HO is aware of the ILR to BC progression of people

A change from ILR to naturalisation I'd not one that Home Office needs notification.

However a change from PBS migrant to ILR long residence is a material change that may require notification or a new application.
