Genuine Entrepreneur Test – Extension Application

Genuine Entrepreneur Test – Extension Application

Hello to all members ,

I have few questions regarding the genuine entrepreneur test (extension applications )the guidance says ,

We will take into account the following:
 the evidence that you submit;
 the viability and credibility of the source of the money referred to in Table 5 of Appendix A;
 the credibility of the financial accounts of the business or businesses;
 the credibility of your business activity in the UK;
 the credibility of the job creation for which you are claiming points;
 if the nature of the business requires mandatory accreditation, registration and/or insurance,
whether that accreditation, registration and/or insurance has been obtained; and
 any other relevant information.

My questions is how HO will check the credibility and decide if the business is genuine or not as every applicants is required by law to provide all the documents and also verified by the registered accountant all taxes will be paid to Hmrc and all evidence of proof of employment will be reported to Hmrc . Can they still refuse the extension application on assumptions finding an excuses like transaction on bank statement don't appear genuine or lets say some applicants have their employees based in other cities due to the nature of business so can they still refuse the application if all documents are genuine and verified and all requirements are met ?? as the policy guidance says the following ,

'If we are not satisfied with the genuineness of application in relation to a points-scoring requirement
in Appendix A of the Immigration Rules, those points will not be awarded'.

Any thoughts on the above by the members here in process of applying their extension ?

You can expect anything from them , but if they identify something not genuine their must be some background audit that's what I think

Obviously HO does not have unlimited time and resources to scrutinize every application. I would say they do a risk assessment of every application and determine whether something needs to be investigated further on that basis. I guess a broad assessment can be done by looking at someone's immigration history, criminal record, HMRC payments and the quality and authenticity of their supporting evidence with respect to the claims they make. If they see something is not quite right, they have every reason to fact-check your claims and ask you to provide more evidence or attend an interview. As long as you have very good reasons for your actions and claims, you should be perfectly fine.
