Baby born after permanent resident card issued

Post by emilgerov1 » Tue Jan 12, 2016 12:19 pm

Hi
Can someone help me or advise me in my situation.
I had my permanent resident cat in February 2015 after I was waiting more than 6 mouth, my child was born in June 2015. We applied for British passport for her in November 2015 still delays in this application. I sent to the passport office my PR card, after 3 weeks I called them and they explain to me that permanent residence card is not leave to remain and the person who was dealing with my documents was disagree with me that this is an evidence that I was exercising my treaty rights for the last 5 years with in regards with EU regulations. So they ask me to send them a letter from the Home Office to prove it, I called Home Office and they was very surprised with this situation and told me to called the passport office again and tell them that the PR is an evidence and they are not able to supply additional letters. Before that I send my P60 for the last 5 years in 2010 I was the have years working as a self-employed and send them the tax return form from the hmrc and they ask me to send them purple card for this year 2010 that I have permission to work. I send them the copy of my purple card the time that I Was working as an employee but they still keep asking me for permission to work for the time that I was self employed . I explained the Home Office this and they said to me that PR card is evidence that I was working legal in the country so I don’t need to give them noting more and that my child is a British and they have to give her passport but still noting they want a letter form them.

This guidance may help - it may be useful to share it with the ill-advised HMPO official/s you are dealing with:
https://www.gov.uk/government/uploads/s ... idance.pdf

PR card is clearly enough.
Table A
Use this table to find out what documents you’ll need to send with the application if the applicant’s parent(s) have not been granted either:
  • British Citizenship
A Permanent Residence Card before the applicant’s birth
All that is gold does not glitter; Not all those who wander are lost. E&OE.

Hi
Thank you for the answer I did send them my PR card but the person who was dealing with the case told me that is not an evidence. I am sure they don't know is PR first he told me that I need to have Leave to remain second he said that The PR needed to be issued in 2010 and then I can use it as an evidence

As well as PR card suggest you send them the guidance too , as they are clearly poorly trained &/or otherwise unaware of it.
