I tried to get a spouse visa for my wife last time i was in the UK (i am a British citizen) but i didn't know she couldnt transfer from a 6 month visitor visa. If i'd known i wouldn't have bothered and it was a waste of money, especially for the one day service. They said there was nothing wrong with the application other than rules say we couldn't apply in the UK on a visitor visa, she had to go back home and apply there.
We are now back in her home country and filling out the spouse visa paperwork and i have a 2 questions i need clarification on:
Have you made an application to the Home Office to remain in the UK in the last 10 years?
Is this a yes? we surely did apply to the home office, but is a spouse visa "to remain"
Have you been refused a visa for any country, including the UK, in the last 10 years?
Is this a yes? we were refused a visa and the country of refusal was the UK.
However, it looks like we were refused twice! i dont want to give that impression, and im not sure of the application for a spouse visa is an application to remain.
