Need advise please regarding wife visa ....

Post by Abdulmoid84 » Sat Jan 16, 2016 3:03 am

Hi members
I got married earlier on 31.10.2013 and divorced my wife. The court decision came on 22.05.2015. I got the union divorse cwrtificate on 02.10.2015. Then i married again in 23.08.2015. Now i am going to apply my wife visa one of my friend told me i cant apply my wife visa because at the time of marriage my divorce wasnt final and because union council issued divorse certificate on 02.10.2015. But i think i can marry once the court decided that my relationship is over with my ex wife and i am free to get married.

Kindly some one advise is it true if i apply my wife visa the home will refuse on the grounds that i am already married so they dont gonna accept my marriage.

Regards
Abdul

Did your first wife get a spouse visa for the UK?

I take it that you married and divorced under Pakistani law, is that correct?

Your friend is correct and you are wrong. You are only "free to marry" after the decree absolute. The decree nisi does not count.

Also see these threads.
EC for wife (second marriage before the first was annulled)

Validity of divorce and 2nd marriage

Second marriage before receiving decree nisi / absolute

Hi thanks for sharing information

I applied for my first wife in october 2013 but eco rejected her visa bcz of my income. I got the decision from the court on 22nd may 2015 and i married again on 23rd oct 2015. After 3 months of divorce now i am confused would eco consider the court decision or a union council decision.

Bcz in pakistan once you get a court decision you need to contact the local council and local council normally takes 3 weeks to issue a divorce certificate .....

Bcz local council issue main certificate on 2nd oct 2015. If i count 90 days from court decision then my marriage is legal according to pakistani law and if i consider local union council certificate then my marriage is not legal...

Now i applied for my wife visa also my documents are ready now i am confused wether to send court decision along with the papers or local union council divorce certificate???

Can someone please advise ???

Regards
Abdul

So be clear....your first wife's spouse visa was approved in May 2015 and three months later in August you married someone else? Did your first wife enter the UK and if so, where is she living now?
