EEA PR HELP

Post by angeleyes » Sun Jan 17, 2016 8:47 pm

Hello everyone,
Will be glad if someone could give me advice on my case.
I entered the UK as an non EU on a PSW dependant visa in 2010 to join my husband who is in the UK since 2006. We got married in India in 2009)
In 2012 Feb I acquired my portuguese nationality.and my Husband got his residence card in sept 2012.
Since october 2011 I have been working for a company.

My questions are

1)Can I apply for Permanent residency in october 2016 or should i be waiting until feb 2012 when i became an eu national.

2) Should my husband wait to apply for PR till 5 years of residence card or can he apply earlier as We have been married for 6 years and living together for 5 years now and having 2 kids.??

Will be glad if someone could guide me please

How did you acquire Portuguese Citizenship?

Some Portuguese citizenship has retrospective effect. Especially if the parent from Portuguese India and you are a son or daughter of the sponsor.

So you naturalised in 2012 without having to prove residency in Portugal following the rule change in Portuguese nationality law in 2006, is that correct? That means you only became an EEA national in 2012 and only started exercising treaty rights then, so the earliest you could qualify for PR is 2017 as far as I am aware.
I'm not sure if there is a loophole that enables you to count the other legal time you spent in the UK before becoming a Portuguese citizen towards your PR clock, you may want to wait for senior members' opinion on this.
All information given is just my opinion as a member of this forum and does not constitute immigration advice.
