Spousal visa query

Hi,

A friend of mine is on Tier 2 visa in England(UK) with CoS (certificate of sponsorship) issued by the employer. She has recently got married to a Stamp 4 holder in the Ireland. The couple have been visiting each other on visit visas (England and ROI) and require a more permanent solution. Can anyone please help with the queries below:

1. Can she apply for spousal residence visa for ROI?
2. Will this impact her Tier2 visa in Engalnd-UK i.e. Can a person be a resident of two countries?
3. Irish embassy have mentioned that they will notify the home office where her Tier2 might be revoked - is this possible?

Your friend needs to be resident and working in the UK to maintain the requirements of her Tier 2 General Visa, this includes meeting the absence requirements.

Just FYI - I have held residence visa at the same time when I was on tier 1, that was for UK and UAE. Maybe it's different for Tier2 then, I'll let her know.

Tier 1 General was a completely different set of rules and you did not have a sponsoring employer.

Tier 2 General, she has a sponsor and if her employer withdraws their sponsorship, her visa will be cancelled. She has to and can only work for her employer.
