Child settlement visa - NHS Surcharge

I got my ILR recently. I am planning to apply for settlement for my child; my son was born in UK in Jan 2014 and is in India since Jan 2015. I thought of registering him (MN1) and apply for citizenship, since that process may take quite some time I am planning to apply for settlement (ILR) instead.

Please can someone help me with the queries below?
1. Do I need to pay NHS surcharge if I apply for his settlement from India?
2. Do I need to register (MN1) him if he got his settlement visa or can I directly apply for his citizenship after certain time?

1. You will probably need to pay it. You might get a refund if it is not required.

2. You will still need to register him on MN1 and can do it as soon as he is back in the UK and don't need to wait. He is entitled to register because he was born in the UK.

Can I register him now while he is away from UK and also apply for settlement from India at the same time?

You can register him but once approved you will not be able to apply for a settlement visa. You would need to apply and wait for a CoE or RoA.

I am not sure if two applications can run and be submitted at the same time.

I went through this link link and its say that one does not need to pay NHS if they are applying for indefinite leave to remain. I am assuming settlement means indefinite leave to remain. Please correct me if I am wrong.

That refers to ILR applied for WITHIN the UK.

My husband would be applying for his ILR in 3 weeks time. He is currently on dependent visa.

ASAP. I am missing him badly . I checked the surcharge calculator and it says I have to pay 1800 fee based on my ILR date.

My husband visa expires in 2017.

No, it should only be max £600.

The child is applying 'alone', you do not enter your details.

Can your husband delay his ILR till your baby is back as then you can apply for a Tier 1 G dependent visa for the child and the visa will be issued in line with your husbands visa so the surcharge will be £200-£300 roughly till next year.

It will be based on your status prior to ILR and the child should get a Tier 1 G dependent visa expiring the same time as your husbands.

As soon as your child is back, hubby applies for ILR and you can apply for childs citizenship on MN1.

U.K. born child may also apply for entry clearance with ILE endorsement, under A280(b), 304-309.

Or, after husband is granted ILR, child may also apply for a child settlement visa.

But you may have to argue that the NHS surcharge should not be applicable too.

I am applying settlement visa for my child who is couple of years old from India. He is born in UK and is currently residing in India with his grand parents.

--He travelled from UK to India, but not from India to UK, I am assuming the answer is "No"

Employment
What is your current working status?
--I selected, "Supported by Spouse/Partner/Other". Please correct me if I am wrong


Medical Treatment
Have you ever received medical treatment in the UK?
I selected "Yes" as he was born here, but what is confusing is I was asked for treatment start and end dates if I select Yes, what dates do I need to give there are he has visited doctor multiple times while his stay in UK

Under 18
Please give details of your parents/guardian(s) in your home country?
Can I give my details here in UK or does it has to be my parents/in-laws details in India?

I am applying for my child settlement visa from India. He was born in UK and is currently in India.

Please can someone help me with the list of documents I need to provide for his visa. I searched on UKVI site, but doesn't find the list of documents to be provided.

I have the following documents handy, please let me know if I am missing something;

1. Child birth and name registration certificate .
2.My marriage certificate (Not sure if this is required).
3.Mortgage statement (This is on my husband name) for residential proof
4. Council tax statement (Both on my and my husband name)
5.My Bank statements for maintenance proof
6.Sponsor letter

Is that a comprehensive list of documents to be provided or am I missing something?
