Hi (I have posted on another thread so apologies if I should of continued there)

My Albanian husband currently in UK on FLR M unable to apply for ILR due to not passing LIUK.

Have been stressing a lot lately (and expecting our first baby) and have decided that if he does not pass the test before his visa runs out we may return to Greece where we met (he has visa free travel there but not work or residence permit!)

My question is are we eligible to apply for EEA FP - work is not an issue as my brother in law has a restaurant there. What other requirements are there?

Second question on the Greek EEA FP would he be able to 'visit' the UK as a tourist (or does he then have to apply for a British one?) if we made the move to Greece we would have no interest to return to the UK except to visit! We're not trying to circumnavigate the rules just trying to make a life for ourselves that's not going to cost £££££££ every couple of years.

Do you mean an EEA FP for husband to go to Greece?
If he is visa-free (for Greece) you are both free to travel there.

Presumably just apply for a Greek RC for husband once you (as sponsor) are exercising treaty rights in Greece; (eg working).

Once established in Greece and, in due course, with an Article 10 or (eventually) Article 20 residence card, husband should be able to enter UK (with you) to visit UK.

UK does ofcourse play hard ball so a UK FP in addition to (or instead of) RC will smooth your passage.
(Unless everything has changed by then with Brexit on horizon & etc).

You do also have the option of applying for FLR(FP) partner route to remain in the UK.
