what are the requirement to apply for RoR(RETAINED RIGHT OF)

Hi All

Please help me on this, i have been married since 2008 from an EEA national, got the 5 years family member visa in 2010, in 2015 due to my partner had not been working for the 5 years continiously i had to apply for another 5 years which was granted and will expire in 2020.

things didn't work out well and we are now divorced.

i need to know please what are the reuirement to apply for RoR (RETAINED RIGHT OF RESIDENCE).

do i still depend on her activities in the UK?

Your RC issued when married will be invalidated once divorced.

You are only sponsored by your EEA spouse (& dependent on them exercising treaty rights as a qualified person, eg worker) whilst legally
married.

To apply for RoR the basics are 3 years of marriage & 1 year residing in UK.

Many Thanks for your response, just one more question please.

Do i need to prove that she was working? how many years required for me to prove that she was working?

Is it 3 years ? as i can only prove that she was working for 2 and half years contiiously only.

Also please what does the application form called?

The sponsor (EEA national) has to be a qualified person exercising treaty rights (in UK).
That could be any combination of working, self-employed, self-sufficient, student.

The relevant time is from date of marriage / date of entry into UK (whichever is latest) until time of divorce.
