FLR(FP) instead of FLR(M) for spouse- pls Help

Post by nohan682 » Tue Jan 26, 2016 4:58 pm

Hi,

Main Applicant Details:

First Landed in UK: Nov'2009
Visa Category: Tier 1 General
Received ILR: Dec'2014 (After completing 5 years on Tier 1 General visa)
Applied for Naturalization: 6th Jan 2016 (After completing 1 year on ILR),Waiting for approval.

Dependent:
My wife first time landed in UK as Tier 1 General dependent in UK March'2011 and details below.

Wife First Landed in UK: March'2011
Visa Category: Tier 1 General Dependent
Left UK as she was pregnant: Sep'2011
Visa Expired: Jun'2012
Applied for Tier 1 General Dependent visa again: Oct'2012(After Dependednt rules had changed effective from june/july'2012)
Came to UK again: Jun'2013 (staying with me in UK from Jun'2013)

Dependent eligibility for ILR/PR rules had changed from 2 years to 5 years effective from june/july'2012. Whether my wife is eligible for ILR/PR through 2 year route as she got her first visa on tier 1 general dependent in 2011 or she will fall under 5 year route to get ILR?

Thanks,
MM

She is on a 5 year route to ILR due to applying for a new entry clearance visa in October 2012.
