apply for stamp4 at GNIB on basis of marriage to Irish national.What is your legal status in Ireland?

Hmmm. Archigabe is right about the process on how to get a Stamp 4 as the spouse of an Irish national. I just don't know if you're overstaying in the North will affect that application to settle in Ireland. Also, to make an application to the Irish embassy in the UK for a visa to enter Ireland, I have no idea if they would require any proof of legal residence in the UK.

How did you initially come to the UK and have you tried to get your status sorted in the UK?

I think it might be easier for you to regularize your stay in the UK. You are encouraged to post in the UK section of this board for more details on UK immigration.

archigabe , yankeegirl, thanks for getting back. When i came they gave me six months before they started requiring visas for zims (zim was still in the commonwealth) and actually travelled to ireland the rules where the same there. Apart from the overstaying am clean, no contact with the authorities here. I have not however tried to regularise my stay in the UK and have not claimed assylum either so obviously there is no sob story. I am trying to see how i can regularise my stay without having to be seperated from my for a long time.

Archigabe is right, the easiest way would probably be to regularize your status here in northern Ireland first.

Since your spouse is also an Irish citizen, you might be able to apply for EEA2 (5 year residence card as the spouse of an EU ctizen) from within the UK. How long have you been married?

It would be a good idea, as Archigabe mentioned, to post in the UK board. There are quite a few people on here that are pretty knowledgeable on UK immigration and they might not chech the Irish board. Also, try telephoning the Law Centre in Belfast. They have an immigration advice line Monday through Friday from 9-1. Feel free to PM me if you would like their number.
