British registration certificate and Indian passport

Post by kg_1218 » Sun Jan 31, 2016 10:56 pm

Hi,

I and my wife got ILR last year and my son who was born in UK and has Tier 1 Dep till Feb 2017.

We are planning to register british citizenship now and we have plans to travel India on Aug-Sep.

- Is it ok to travel india with British registration certificate (hope i'll get this before Aug) and Indian passport as I dont think I would be able to apply British passport before Aug?

- My son indian passport is going to expire on last week of sep but will be back to uk on 1st week of sep. Do you think I can travel to india and come back to uk without any issue?

Thanks

He can use his visa BRP to re-enter the UK. A registration document is not a travel document and unlikely Stupid will accept it as proof.

Bear in mind that should you receive the certificate in a short space of time, your son can only travel up to 90 days on his Indian passport.

A child British passport is quick if you use the fast track service, it takes about a week.

Thanks CR001.

CR001: He can use his visa BRP to re-enter the UK

-- I think I need to return BRP card within 5 days after getting the registration certificate. Am I wrong?

CR001: Bear in mind that should you receive the certificate in a short space of time, your son can only travel up to 90 days on his Indian passport.

-- sorry I dont get you. Do you mean if I get the certificate say in 1st March (definitely wont happen) then I can use the indian passport only till 30th May? If so, could you send me the link where it states?

-- Yes but I need to apply OCI or indian visa after getting the british passport which will take few more weeks i think.

It should be yes. I was answering on the basis that you DO NOT have the registration certificate when you go on holiday.

India doesn't not allow dual nationality. You should be aware of your own country's requirements. Once your child is British (date of registration certificate), he only has 90 days in which he can use his Indian passport without facing penalties. Further down the main forum page is the 'Other Countries' forum, ask questions relating to OCI and surrender of passport there.

The two are totally separate issues. I was advising that child passports can be done quicker.

Thanks.

I know India doesnt allow dual nationalities but I was not aware about 90 days rule.

I think I have 2 options:

1. Apply the citizenship after my holiday (as my son has BRP validity till Feb 2017)

OR

2. Apply the citizenship closer to my holiday, so i should be fine with 90 days rule.

Do you think it should be fine to travel and come back in sep 1st week as my son passport will be expiring last week of sep?

Traveling is fine as long as passport is valid on the date of return.

Please note that citizenship fees are increasing in April. Current MN1 fee is £749. From April it is likely to be £936.

Thanks CR001.

I'm thinking to apply the citizenship for my son last week of March, so I can pay the old fee. Here I've few concerns:

1. I've already (Last week of Jan) got the signature from 2 references, can I use the same when I apply in March (it'll be around 3 months)?

2. I think normally it takes minimum of 3 months for MN1 processing, so if registration certificate arrive after June, I can travel in August without applying british passport as I really dont want to take the risk of applying passport and visa before travel.

3. I read somewhere we can apply both MN1 and bristish passport at the same time, is it implemented in all NCS centres? If yes, please provide a link if any.

Thanks
