Non-EU family member rejected - going to the court ?

Hi,

our application for a residence permit was rejected last week with the motivation that we did not reside in an other EU country before to arrive to Ireland. Today we received a stamp 3 from the GNIB.

I am Italian, my partner is Mexican, and we have a son (both nationalities) 2 years old. We applied for a "permission to remain" during May 2006 and the EU treaty rights section needed just 19 months (and one passport lost!) to give us an answer.

Also, I feel that the rights of my son are violated here, because we did not have the possibility to apply for the child benefit for him yet.

Now we are thinking to ask the help of a sollicitor and to go to the tribunals to ask for damages and to have our rights respected.

What I would like to know is how expensive may be it, and also a list of possible sollicitors if anyone knows someone.
