Within 28 days of this date. What date did you get your spouse visa and on what date did you enter the UK?

Thanks for you reply, I entered uk on student visa in 2011, and I got my spouse visa in 23 November 2013

I was thinking how come they allowed (asd1) to apply for the visa 2.5 months earlier then the expiry. Here is the link

Also can you also advice how to calculate my annual salary?

You can apply early if you wish, but you will then have a shortfall to make up 5 years residence and will have to apply for another extension just to cover a couple of weeks/months.

Financial requirement Basic + commission

Post by bilalbilal » Thu Feb 18, 2016 1:44 pm

Hi all can someone please clear this as I'm scared to make any mistakes, I have been working with the same employer for last 2 years.

I get basic salary of £1219 per month + commission + Overtime

I get extra £86 for living inside M25 Of London, Sometimes I also get holiday pay.

My question is, will UKBA consider my holiday pay and London allowance?

2nd question is What catogory I fall in?

Thanks a lot in advance.

What's your gross pay each month?

It needs to be at least £1550, otherwise you won't be earning above the required amount.

Premium appointment (Saturday or Monday?)

Post by bilalbilal » Mon Mar 14, 2016 5:00 pm

Hi everyone,

I'm currently on 2.5 spouse visa which will expire on 21st May 2016

Can I apply on the 23rd April? And is it ok to apply on Saturday?

Some of my friends are telling me not to apply on Saturday as home office won't be able to do verification checks on Saturday and they might say we will give you the results later.

Thanks in advance

You can apply on any day, it doesn't make much difference. They could have problems on a week day and not give an answer on the day either. It is a risk you take paying premium service fee.

You are aware of the 25% fee increase from 18th March presumably.

Thank you, yes I'm aware of the fee increase that's why I have already booked the appointment for 23rd but my friend made me confused that home office won't be able to do the verification checks with my employer on Saturday. But if I provide the bank statements and payslips both signed then shouldn't be a problem. Or can it be a problem?

HO can check on the HMRC system who your employer is. I don't believe it will be an issue. They don't routinely contact employers unless there is a very obvious problem with your documents.

FLRM Extension Cohabitation requirement

Post by bilalbilal » Mon Mar 28, 2016 11:20 am

The dates of the items of correspondence should be spread evenly over the whole 2 years. They should be from at least 3 different sources. If you do not have enough items in your joint names,
you may also provide items addressed to each of you individually if they show the same address
for both of you.

I live with my parents so i don't have tenency agreement and I don't pay any council tax.

So the only source I have is bank statements, credit card bills, mobile phone bills.

My question is can 3 different sources be 3 different banks accounts?

Thanks in advance

FLR M financial requirement Help please Amber

Post by bilalbilal » Sun Apr 10, 2016 10:04 pm

Hi thanks in advance.

I previously asked the question on this Board that if the Commission based pay will be counted towards meeting the financial requirement. so i was told that commission based pay will be considered.

My question is as i am applying in April, do i have to put the total income i earned till march 2016? which was the end of financial year? which is £42000

or

shall i calculate the basic salary, overtime and commission in the last 6 months average multiply by 12 months? which is £38757 per annum?

Which category you are applying for ? Salaried, non salaried, self employment?

Non-salaried employment includes that paid at an hourly or other rate (and the number
and/or pattern of hours required to be worked may vary) or paid an amount which varies
according to the work undertaken. Salaried employment includes that paid at a minimum
fixed rate (usually annual) which is usually subject to a contractual minimum number of
hours to be worked.

The only difference in Category A between salaried and non-salaried employment is
how gross annual salary or employment income is calculated:
Where the person is in salaried employment – they must have been paid throughout
the period of 6 months prior to the date of application at a level of gross annual salary
which equals or exceeds the level relied upon in the application. Therefore the figure
used towards the requirement will be the lowest level of annual salary received during
the 6 month period.

Where the person is in non-salaried employment – the level of gross annual
employment income relied upon in the application will be the annual equivalent of the
person’s average gross monthly income from non-salaried employment in the 6 months
prior to the date of application (where that employment was held throughout that period).
To calculate this annualised average for non-salaried employment in Category A the
following calculation should be used:
(Total gross income from employment held throughout the 6 month period, divided by
6) multiplied by 12 = Income from non-salaried employment that can be counted towards
the financial requirement.

Hi thanks for your reply.

I'm applying in category A. Salaried employment, my basic salary is £14600 per year + commission (which fluctuates)+ overtime + London living allowance (£1080 per year) total p60 was £42000

My calculations are based on

5.5.9. Case study – Calculation of commission based pay

Example (a)

The applicant’s partner currently lives in Thailand and is returning to the UK with the applicant.

The applicant’s partner is employed at the date of application and is relying on Category A. He works as a car salesman in Thailand in salaried employment. In the 6 months prior to the date of application his gross annual salary was £15,000. He also received commission based pay for each of the 6 months prior to the date of application which varied as follows:

£500, £1000, £400, £200, £200, and £800.

The income from commission based pay that can be added to the salaried employment = (total commission earned over the last 6 months, divided by 6) multiplied by 12
= ((500+1000+400+200+250+800) ÷ 6) x 12
= (3150÷ 6) x 12

= £6,300
This annualised income from commission based pay can then be added to the salaried

Hi CR001,

What is the ideal occupancy for a 4 bedroom house?

Currently, we are three couples and two boys aged, 16 and 9 years old.

We are applying for FLR (M) in July.

Will the tenancy agreement qualify the requirement.
