Is child eligible for Irish Passport/Citizenship

Post by spirit123 » Fri Feb 19, 2016 12:26 pm

I recently received UK ILR and I have been working in Northern Ireland for the past 3 years (From Feb 2013).
My daughter was born 6 months back in Northern Ireland, at the time of her birth I didn't have ILR.

Is she eligible for Irish citizenship by birth?

You may be able to register the child as British if he/she was born before you acquired ILR. However you cannot apply for Irish Citizenship as you had not lawfully resided in Northern Ireland in the 3 years preceding the child's birth.

Sorry Obie, do you mean 'born before getting ILR'
You may be able to register the child as British if he/she was born after you acquired ILR

Correct. I have been saying the opposite of what i meant in two sets of post.

I intended to say born before ILR section 1(3) registration.

Born After Parent Acquired ILR section 1(1) Entitled to Citizenship.
