Naturalisation Good character

Post by niyiola99 » Wed Feb 24, 2016 10:38 pm

hi can someone pls advice. I am about to apply for my naturalisation after i was granted my EEA permanent resident last year November 2015 under the surrinder singh case law but scared it might be refused under the Good Character requirement as i did not acquire a visa when relocating along with my British national spouse in 2009. We came in together and as usual there was no immigration checks done as at the time of our arrival. My question is would i be treated as coming in legally as i travel along with my eea/ british spouse as at the time of entry under the eea free movement act or be treated as breaking the immigration law as i did not acquire the correct entry visa

If you were travelling under the free movement rules, you should be OK. Perhaps a SAR (click) from the Home Office will confirm what information they hold.

Thx Amber for the advice, however i think the SAR might not be possible as every flight from ireland to the uk is treated as a local flight (well as at the time we came in). There was no immigration at the border, we just came in without any checks or clicks, Like you would if you take a flight lets say from Manchester to London. what other advice would you recommend

If the SAR came back without any information, then it would unlikely cause an issue.
