EU FAM separated

Post by langolu » Wed Feb 24, 2016 12:17 pm

Hi all, I am on EU FAM 4 stamp but not living with my partner at the moment. She has another boyfriend whom they now have a child together in ireland. My passport is expiring and need the get the remaining stamp of my 5 years on my new passport. I want to know if this will be a problem at the GNIB office.

Thank you all

The permit is issued to eu spouses and i believe if you are separated for good then you have no right to stay in EU,

and you would need your EU spouse to be with you at the immigration to get the visa extension and they would also ask if the EU person still exercising the treaty rights and would need the proof of that.
I am because we are.

You must write to the department of Justice informing them of the changes that has occurred in your relationship.

Provided your wife is still in the state and exercising treaty right I think you should be ok.

Then you may have a continued right to your residence card and it may be a breach of EU law if they refuse to issue it .
