Register a foreign marriage

Dear Sir,
I applied spouse visa in uk last December 2014 for marriage in September 2014. Capita visted my home, sent me questionnaire uptil interview everything was fine. But due to health problems we couldnt go for interviews twice. And my lawyer withdrew my application. Capita writting me letter that being EEA spouse i need fresh application. But main point is that I don't want to go again same long procedure. I visited My wife embessy to register to register marriage, travel and get visa from there as advised by an other lawyer. But my EEA a wife embassy said, i cant travel or get visa until i hv sort out visa in UK. My question is it as they said. Don't i fall in EEA visa free travel catagory, and after translated marriage certificate can't i get visa if i go there. ?

Why did your lawyer withdraw your application ?
What health issues prevented you from attending the interview ?
When you say Capita visited your home do you mean Immigration Enforcement ?
You say you applied for Spouse visa but then you talk about free travel and also talk about visiting your wife's embassy. If your wife is eea you are supposed to apply for EEA FM Residence card and not a spouse visa.
