Urgent problem need help!!!!!!

Post by TBX » Thu Dec 13, 2007 3:53 pm

I came here from Africa in 2oo1 as a dependant on a wife's visa. The wife is a workpermit holder and our children joined us in 2003 and are also dependants on her visa.My wife renewed our visas twice since we came here and before she sent the passports for renewal on the third time , we were having marital problems. On the third time she indicated to me , that she was not going to do it for me despite the fact that we were and are still legally married though at that time we were living separately because of work locations.I then made an application on my own behalf explaining that our marriage is still existing and we have two kids , but living separately.Home office refused saying I did not include my kids' birth certificates. After this accassion , my wife then decided to extend my LTR as her depenadant(which has always been the case). We did this through a solicitor . and when the home office were about to issue me with the extension, she wrote a letter barring them from issuing me with the extension sighting the reasons that, she suspected I was having an affair.I then approached the IAS who did another application to home office explaining the abuse I was getting from my wife and also enclosing the evidence of police and hospital reports on assaults. This application is still with the H/O since May last year.We are now back together and living in the same house and she hasn't applied for her indefinite leave to remain yet.Is there any need for me to inform the home office about our coming back together. The other thing is IAS said if they were to write to H/O they need a letter from my wife confirming that we are now living in the same house and knowing my wife as i do , she will be reluctant to do it.Should i wait for the H/O to reply or inform them as well about the change of circumstances. Please help.

If you have applied as a victim of domestic violence and are now back with your wife then the application is no longer valid, and to continue with it would be fraudulent. You should withdraw the application immediately if you intend to stay together.

Thanks Victoria for replying, the thing is her behaviour is very unpredictable, and like i said she knows we are now back together and is not doing anything to sort out the papers for me.Thats why i am asking if i sholud take that initiative and inform h/o about the circumstances and if i do will they reconsider my original status i.e dependant ?

I can't advise on this. I think you need to decide what is best for you. I can guarantee that if you were a woman posting people would have no hesitation but to advise you to leave and continue with the domestic violence application. But you are the only person who can decide.
