questions about applying for spouse visa

Post by rosevilla » Wed Mar 02, 2016 10:45 pm

Hi

I am British citizen and would like to apply visa for my spouse.

She is having tier 2 work permit visa sponsored by NHS and validity period from 04/10/13 to 06/09/2016.

She came to UK in 2007 as dependant of my student visa and she was been changing tier 1 dependant and PBS dependant until she got her own sponsored visa, which was 4/10/2013.

The NHS trust can’t sponsor for her renewal, therefore I want to change her visa which is Tier 2 general to dependant of British citizen visa.

Please let me know, what will be the application for her to apply? is it FLR(M) OR FLR (O) also can she apply two years route or five years route? she is been in uk since 2007 april on wards therefore can she apply 2 years route?

please can you reply to this post by experienced person

You can't apply for a Tier 2 G dep visa if you are British. It is a spouse settlement visa that has to be applied for on form FLR(M) and you have to meet all the requirements. It will be a 5 year route to ILR on FLR(M) (or 10 years long residence in 2017 if she meets all the requirements).

There is no longer a '2 year route'.
