My Girlfriend refused Visa

Post by mahonga » Sat Dec 01, 2007 8:50 pm

Hello i am an Irish citizan. My Ukraine Girlfriend has been refused a tourist visa to come to Ireland. She just wanted to come hear for 1 week and the Embassy in Kiev say no. We are at a crossroads now. She will appeal the decion but we think it will not make a difference. The reasons they gave was THE APPLECANT HAS NOT ASKED TO TRAVEL TO ANY OTHER COUNTRY BEFORE. And why she want to come to Ireland. If anybody knows anything to help please reply or if something like this has happened before to somebody. Please help me

From what I hear, it's standard policy to refuse visit visas at first.they might reconsider if she appeals.

They will say NO NO NO NO and then YES

She needs to provide as much evidence as possible that she intends to continue with her life after the visit to Ireland. Job, apartment lease, long term commitments...

It's a bit of an overstatement to say that it is standard policy of the DoJ refuse all 1st applications! I know many people who were issued with their Tourist Visa on 1st application.

I've never heard of that Reason being given before, and it may be worth asking the Embassy in Kiev for some direction on this. The reason given doesn't match up to any of the usual reasons given, and doesn't seem to match with the "Reasons for Refusal" doc on the DoJ website. Is this the reason that was written in her refusal letter?

I presume the application was sent on to the DoJ in Dublin for processing? As Directive/2004/38/EC pointed out, a large bulk of her application should include documentation showing that she intends to return to the Ukraine after her visit. Flight bookings can be used to show intention to return also.

She has appealed the decsion on the grounds that she has to return back home to finish her university studies. I hope all will turn out good.

At one stage the UK was also known for refusing visit visas to people on the basis of not having applied for a visa before!!!

You almost have to look twice when you read that. "We can't issue you a visa because you have never been issued a visa". Probably the most insane reason for a visa refusal ever.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Just like, "we can't offer you credit, because you have no credit history!"

Appeal Turned Down

Post by mahonga » Wed Dec 12, 2007 10:10 pm

My girlfriend has her appeal now turned down. We prepared a letter for the visa officer against there ruling but they still said no on the same ground as last time that the aplecant has no previous travel history. Its not fair i dont now what we will do now :(

At some point, my second visit visa to visit my then girlfriend in Ireland was turned down even though I had been in Ireland just 3 months previously.the only difference was that the first time I had applied from the U.S, the second time from Asia...I feel your frustration!

What evidence did you provide that she plans to return home after the visit?

The evadance she provided that she would return back home is that she has to finish her univercity studies. She has doucments from the college stating this.

Not a nice situation to be in...

Why doesnt she get a visa to goto Northern Ireland then you can visit her there.

Though with an open border you could always show her a bit of Ireland too. ;-)

Good luck!
