Do I qualify for a Dutch Passport?

Post by Peter Salomons » Wed Mar 09, 2016 11:47 am

Hi everyone.

I am a South African born national. Both my parents (mom and dad) emigrated to South Africa in the 1950-1960 with their parents.
They finished their schooling in South Africa. My mother studied to become a nurse and my father became a plumber.
Due to the laws in South Africa at the time, both parents were forced to relinquish their Dutch citizenship in their mid 20's, as both were refused qualification recognition by the state due to them being Dutch citizens(my mother as a registered nurse, and my father as a qualified plumber).
At the time it would have been impossible for my mother to work as a registered nurse, as all healthcare in South Africa at the time were provided by the state. In the same instance for my father, the state also controlled the registration of Tradesmen.

Both then became South Africans by force in order to secure employment.

In 2011, both parents got their dutch Nationality back and they both have their Dutch passports.
I was born in 1972, both parents were classed "South Africans" at the time. Both parents are of the opinion that if they were not forced to relinquish their citizenship at the time, it would mean that i would then have been born from Dutch parents. However, due to them being "South Africans by force" at the time, i do not qualify for a passport.

Does anybody know if there is a different process to be followed whereby the above is being weighed up and taken into consideration.

Please advise
Peter

Dutch nationality law is complex and they are pretty unforgiving. Have a look at the thread below and the link I provided in it (post #3 I think)
