Does any one have any experience of applying for fp 10 year route . My wife as just battled cancer and needs be within the Uk for some ongoing years to recieve check ups and any further care. What do you think are chances are under the human right act also.

I know this as been spoken about before but was just wondering if there is any more information been found out what it means once the ihs refund option as been removed.Mine was removed a week ago but since have also received letter to do biometrics so surely the ihs refund option can not mean a descision as been made? A friend in same position also received biometrics letter but her ihs refund option is still showing .

Not sure what you mean. Have you received a refund of the IHS fee?

My wife is a British citizen , however I'm on in the uk on a visit visa which was granted for me to be here through her cancer treatment , we have since learnt she needs to remain in the uk for at least 5 years for regular check ups due to the high risk of recourance

No refund received yet but the refund option as been removed from the ihs Acount page , people have said this gets removed once descision been made?

Hi .
My application for flr fp has been refused but have been given a right to appeal based on human right grounds article 8. My wife was diganosed with cancer last year and now needs to remain in the Uk to have regular / yearly check ups/ scans to check the cancer not returned and also next year will require more surgery . She is a Brirish citizen . What does anyone think are chances are at winning the appeal on the grounds of her medical care needed for at least another 5 years or longer if she has a relapse. Also we will struggle to have any one of life back in my home country due to not being able to earn much to live and the fact we will need to pay for her care needed in my home country. Can any one advice if we will be fighting a loosing battle or have good fronds to be won at appeal under human rights? I only entred the uk on a visit visa to help my wife through her cancer treatment so we was an expecting a refusal due to this. A solicitor has adviced it's good we been given right of appeal at that human rights have been recognised , just be nice to hear what people's experience or advice would be with similar grounds that I've outlined above regarding the need for her ongoing care/ check ups and if this will be strong enough to win on including the fact we would struggle to have a private life in my home country if we did return there'.

Be guided by your solicitor, but strong medical evidence should go in your favour.
